    Senator Unger moved to amend the bill on five, section eight, subsection(g), following subdivision (3) by adding a new subdivision four to read as follows:

    (4) Any Class B facility seeks a certificate of need, authorized in this section, to build a separate cell dedicated to drill cuttings and associated drilling waste that exceeds its tonnage limits as defined in section two, article four, chapter twenty-two-c of this code shall apply for approval to convert to a Class A facility as set forth in section twenty-seven, article four, chapter twenty-two of this code.
